NYCTRR § 4-07(b)(1), “Obstructing Traffic”

New York City Traffic Rules & Regulations § 4-07(b)(1) prohibits motorists from stopping or standing in a lane designated for driving. The fine is $138. Pleading guilty or being found guilty of this violation will put two points on your driver’s license. If you are from out-of-state, it will probably transfer to your home state. Most importantly, such violations on your driving record typically cause increased insurance rates.

The wording of the relevant regulation is as follows:

(b) Obstruction of traffic.

(1) Traffic lane. No person shall operate a vehicle in a manner which obstructs traffic in lanes specifically designated for the movement of traffic. Such lanes include, but are not limited to, no standing zones and no stopping zones.

The best way to beat a traffic ticket in the TVB is by finding something wrong, whether factual or legal, whether a contradiction or an omission, with the ticket, the officer’s testimony, or the officer’s notes. If you come to the hearing planning on presenting a counter-narrative to the officer’s version of the events, you will probably lose the case.
