VTL 1160(c), Improper Left Turn (one way street)
Vehicle & Traffic Law § 1160(c) states:
Left turns on other than two-way roadways. “At any intersection where traffic is restricted to one direction on one or more of the roadways, the driver of a vehicle intending to turn left at any such intersection shall approach the intersection in the extreme left-hand lane of the roadway lawfully available to traffic moving in the direction of travel of such vehicle or, where travel on the shoulder or slope has been authorized, from the shoulder or slope, and after entering the intersection the left turn shall be made so as to leave the intersection, as nearly as practicable, in the left-hand lane lawfully available to traffic moving in such direction upon the roadway being entered.”
To simplify, there are intersections that have designated left hand turning lanes. These lanes should be marked with a clear unobstructed sign or a white arrow on the ground that looks like a left turn, or both. All signage will be located as left as possible amongst all the lanes.
If a driver intends to turn left, they need to be in this specific left lane to do so. If there is a designated left turning lane, and a driver makes the turn from the center lane, they can be ticketed for a violation of VTL 1160(c).
A first-time conviction for VTL 1160(c) will result in 2 points, and a maximum $150 fine, in addition to a mandatory state surcharge. A second conviction can result in a fine of up to $300 plus surcharge. A third conviction raises the maximum fine to $450. With other violations on your record there may be a Driver Responsibility Assessment Fee. Finally, any such violation will be seen by your insurance company, and you will likely see an increase in your insurance rates.
